These Terms of Use ("Terms") govern your access to and use of Casa, a mobile application provided by EveryFit, Inc., doing business as QMedic ("EveryFit," "we," "us," or "our").
By creating a Casa account or using Casa, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, do not use Casa.
Casa is designed to help users stay connected to people they trust while working in the field or completing visits on their own.
Casa allows users to connect a supported calendar, organize scheduled events as visits, designate trusted individuals as Buddies, and communicate with Buddies regarding visits. Casa also includes an SOS feature that allows users to send an alert to designated Buddies and share their location.
Casa is not an emergency response, medical, healthcare, or monitoring service and does not contact emergency responders on a user's behalf.
You must be at least 13 years old and located in the United States to create or use a Casa account. Casa currently supports United States mobile phone numbers.
If you are under 18 years old, you may use Casa only with the consent of your parent or legal guardian. By using Casa, you represent and warrant that you meet these eligibility requirements and, if you are under 18, that your parent or legal guardian has consented to your use of Casa and these Terms.
You may not use Casa if you are prohibited from doing so under applicable law.
To use Casa, you must create an account and provide your first and last name and a U.S. mobile phone number. You may optionally provide an email address. Casa uses a one-time passcode (OTP) as part of the registration and verification process, and your device's time zone is detected for app functionality.
You are responsible for providing accurate information and for maintaining the security of your account and device. You should promptly update your account information if it changes and notify us if you believe your account has been accessed or used without authorization.
Certain Casa features depend on permissions, settings, or third-party integrations, such as calendar access, location services, notifications, and, if you choose to select a Buddy from your device contacts, Contacts access.
You may choose whether to grant certain permissions or connect supported third-party services. If you decline or revoke a permission, disconnect an integration, or change a device setting that Casa relies upon, some features may not function or may become unavailable.
Casa allows you to connect a supported calendar and use calendar events in connection with Casa visits. Depending on the information available in the connected calendar, visit information may include details such as the event title, date, time, duration, location, and notes.
You may be able to add or update certain visit information within Casa, including location or address information, and select Buddies for a visit.
Users are responsible for reviewing their visit information and for starting and completing visits as appropriate. Certain Casa functionality, including location and Buddy communications, may operate in connection with the start, completion, or status of a visit as described in these Terms and the Privacy Policy.
Casa allows you to invite people you trust to participate as "Buddies." You may initiate a Buddy invitation by providing the person's requested contact information or, if you choose, selecting the person from your device contacts.
Casa may use the information you provide to send that person an invitation. An invited person may accept or decline the invitation and does not become an available Buddy unless the invitation is accepted.
Once a Buddy accepts an invitation, the Buddy may become available for selection in connection with your Casa visits. Depending on your Casa settings and the applicable visit, you may designate one or more available Buddies to receive visit-related communications or SOS alerts.
Buddies do not need to create a Casa account or download the Casa app to receive supported SMS communications.
You are responsible for selecting appropriate Buddies and maintaining accurate Buddy contact information. Casa does not guarantee that a Buddy will be available, receive or view a communication, or respond when contacted.
Casa may limit the number of Buddies that can be associated with an account or assigned to a visit. These limits may be configured by EveryFit. Up to three confirmed Buddies may be designated as Default Buddies and automatically associated with new visits, subject to current Casa configuration.
Casa includes an "SOS" feature that allows a user to request help from designated Buddies in connection with a visit.
When you send an SOS, Casa will attempt to notify the applicable Buddies using supported communications and may share available location information to help those Buddies locate or assist you. Casa may capture your location when you send an SOS, as described in the Privacy Policy.
If usable location information is not available, Casa may request additional location or address information from you to support the SOS.
Casa is not an emergency service or emergency monitoring service. Sending an SOS through Casa does not contact 911, law enforcement, fire, emergency medical services, or other emergency responders.
Casa cannot guarantee that an SOS or related communication will be delivered, received, or viewed, or that a Buddy will be available or respond.
If you believe you are in immediate danger or are experiencing an emergency, contact 911 or the appropriate emergency service directly.
Casa uses SMS and other service-related communications for account verification, Buddy invitations, visit-related communications, SOS alerts, and other operational messages. By providing a mobile phone number and using features that rely on SMS, you understand that service-related text messages may be sent in connection with your use of Casa. Message and data rates may apply, and delivery depends on your mobile carrier and other services outside EveryFit’s control.
You or a Buddy may opt out of Casa SMS by texting STOP, STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT to the Casa number. An opt-out stops Casa SMS to that phone number until the person opts back in by texting START or UNSTOP. A carrier-required confirmation message may still be sent when an opt-out is processed.
If a Buddy opts out, Casa will identify that Buddy as opted out, decline any pending invitation, remove the Buddy from Default Buddy assignments, and notify the account holder that the Buddy can no longer receive Casa safety communications. A visit cannot be started without at least one confirmed Buddy. If the Buddy later opts back in to SMS, the prior Buddy relationship is not automatically restored; the account holder must send a new invitation and the person must accept it again.
If a Casa account holder opts out of SMS, Casa may pause app functionality that depends on SMS until the account holder opts back in. During an active visit or SOS, Casa will continue to allow the user to finish or cancel that active visit or SOS. While the account holder remains opted out, login verification may be offered by automated voice call, and account deletion may require assistance from the Support Team rather than the normal self-service flow.
Casa uses location information in connection with certain visit and SOS features.
Casa may capture location information when you start a visit and when you send an SOS. Available location information may be used or shared with applicable Buddies in connection with Casa functionality.
If usable location information is unavailable, Casa may allow or request you to provide an address or other location information.
Casa does not continuously track your location or follow your location in the background.
Your ability to use location-dependent features may be affected if you disable location permissions, location services are unavailable, or Casa is otherwise unable to obtain usable location information.

Casa provides an in-app account-deletion process. You may initiate deletion from Profile Settings and confirm the request using a 6-digit verification code sent by SMS or automated voice call. Account deletion cannot be completed while a visit or SOS is active or unresolved.
Once account deletion is completed, information associated with the account will be deleted or retained in accordance with the Privacy Policy and applicable requirements. A public account/data-deletion request path is also available through the Casa website and support process.

Casa relies on third-party services and integrations to provide certain functionality, including calendar connections, communications, mapping and location-related functionality, mobile platform services, and technical support and error-reporting services.
Your use of certain third-party services may also be subject to the applicable third party's terms, privacy policies, permissions and availability.
EveryFit does not control the operation or availability of third-party services. If a third-party service is unavailable, disconnected, modified or discontinued, certain Casa features may be limited, interrupted or unavailable.
Information about how Casa and its service providers collect, use and process information is provided in the Privacy Policy.
You may use Casa only for lawful purposes and in accordance with these Terms.
You may not use Casa in violation of applicable law or the rights of another person; impersonate another person or provide materially false or misleading account information; attempt to gain unauthorized access to Casa, another user's account, or systems or networks connected to Casa; interfere with, disrupt or impair the operation or security of Casa; introduce malicious code or use Casa to transmit harmful or unlawful content; use automated means to access, scrape or extract information from Casa except as expressly authorized by EveryFit; or attempt to circumvent security features or other technical restrictions designed to protect Casa or its users.
EveryFit may take appropriate action in response to suspected misuse of Casa as permitted by these Terms and applicable law.
Casa, including its software, design, features, functionality, text, graphics, logos and other content provided by EveryFit, is owned by or licensed to EveryFit and is protected by applicable intellectual property laws.
Subject to these Terms, EveryFit grants you a limited, personal, non-exclusive, non-transferable and revocable right to access and use Casa for its intended purposes.
Except as permitted by applicable law or expressly authorized by EveryFit, you may not copy, modify, distribute, sell, license, reverse engineer, create derivative works from, or otherwise exploit Casa or its proprietary content.
These Terms do not transfer ownership of Casa or EveryFit's intellectual property to you.
You may stop using Casa at any time and may request deletion of your account as described in these Terms and the Privacy Policy.
EveryFit may suspend or terminate access to Casa if it reasonably believes that a user has materially violated these Terms, used Casa unlawfully or in a manner that threatens the security or operation of the Service, or where suspension or termination is otherwise reasonably necessary to protect Casa, its users or EveryFit.
EveryFit may also discontinue Casa or particular features of the Service, subject to applicable law.
Following termination or account deletion, information associated with the account will be deleted or retained as described in the Privacy Policy.
Casa is designed to help users stay connected with people they trust while conducting visits or other work in the field. Casa is a supplemental communication tool and is not an emergency response service, emergency monitoring service, medical service, healthcare service, or substitute for contacting emergency responders.
The SOS feature is designed to attempt to send communications to designated Buddies. SOS does not contact 911, law enforcement, fire departments, emergency medical services, or other emergency responders on your behalf.
Casa cannot guarantee that an SOS, SMS, push notification, or other communication will be successfully transmitted or delivered; that a Buddy will receive, view, or respond to a communication; that location information will always be available, timely, or accurate; or that a mobile device, cellular network, internet connection, calendar provider, location service, or other third-party service will operate without interruption.
You should not rely on Casa, the SOS feature, or any communication sent through Casa to prevent or protect you from harm or as your sole means of obtaining assistance in an emergency. You remain responsible for exercising appropriate judgment and taking reasonable precautions for your personal safety, including contacting emergency responders directly when appropriate.
If you believe you are in immediate danger or are experiencing an emergency, contact 911 or the appropriate emergency service directly.
To the fullest extent permitted by applicable law, Casa is provided on an "as is" and "as available" basis. EveryFit makes no warranties, express, implied, statutory or otherwise, regarding Casa, including its availability, reliability, accuracy, security or operation.
To the fullest extent permitted by applicable law, EveryFit expressly disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, except to the extent that any such warranty cannot be disclaimed under applicable law.
To the fullest extent permitted by applicable law, EveryFit and its officers, directors, employees, affiliates, agents and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profits, revenues, data, goodwill or other intangible losses, arising out of or relating to your use of, or inability to use, Casa.
Without limiting the Important Safety Information in these Terms, EveryFit does not guarantee the delivery or receipt of communications, the availability or response of a Buddy, the accuracy or availability of location information, or the uninterrupted operation of Casa or third-party services on which Casa depends.
To the fullest extent permitted by applicable law, the aggregate liability of EveryFit, Inc., a Delaware C-Corporation, for all claims arising out of or relating to Casa or these Terms will not exceed the greater of (a) $50 or (b) the amounts, if any, you paid to EveryFit for Casa during the 12 months immediately preceding the event giving rise to the claim.
The exclusions and limitations in this Section apply to the fullest extent permitted by applicable law and do not exclude or limit liability that cannot lawfully be excluded or limited, including liability for personal injury or property damage to the extent such liability cannot be excluded or limited under applicable law.
To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless EveryFit and its officers, directors, employees, affiliates and agents from and against any claims, liabilities, damages, losses and reasonable expenses arising from or relating to (a) your misuse of Casa, (b) your material violation of these Terms, or (c) your violation of another person's rights.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where applicable mandatory law provides otherwise.
Informal Dispute Resolution. Before initiating arbitration, you and EveryFit agree to attempt in good faith to resolve any dispute arising out of or relating to Casa or these Terms informally. The party seeking to raise a dispute must provide the other party with written notice describing the dispute and the relief sought. If the dispute is not resolved within 30 days after receipt of the notice, either party may initiate arbitration.
Binding Individual Arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to Casa or these Terms that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration may be conducted remotely, by written submissions, or in person as permitted by the applicable AAA rules and applicable law.
Exceptions. Either party may bring an individual claim in small claims court if the claim qualifies and remains in that court. Nothing in this Section prevents either party from seeking relief from a court or governmental agency where such relief cannot lawfully be waived or made subject to arbitration.
Class-Action Waiver. To the fullest extent permitted by applicable law, you and EveryFit agree that disputes will be resolved only on an individual basis and not as part of any class, consolidated, representative or collective action or proceeding.
Jury-Trial Waiver. To the fullest extent permitted by applicable law, you and EveryFit waive any right to a trial by jury for disputes subject to arbitration under this Section.
Arbitration Fees. Payment of filing, administrative, and arbitrator fees will be governed by the applicable AAA rules and applicable law. EveryFit will pay any fees that it is required to pay under those rules or applicable law.
Right to Opt Out. You may opt out of the arbitration provisions of this Section by providing written notice to EveryFit within 30 days after you first accept these Terms. Your notice must clearly state that you are opting out of arbitration and include information reasonably sufficient to identify your Casa account. Opting out of arbitration will not otherwise affect these Terms.
Severability and Statutory Rights. If any portion of this arbitration agreement is found unenforceable, that portion will be severed to the extent permitted by applicable law and the remaining portions will remain in effect, except where applicable law requires otherwise. Nothing in these Terms waives any right or remedy that cannot lawfully be waived under applicable law.
EveryFit may update these Terms from time to time to reflect changes to Casa, applicable law, or our practices.
If we make material changes to these Terms, we will provide reasonable notice before the changes become effective, as required by applicable law. Notice may be provided within Casa, by SMS or email using contact information associated with your account, or by other reasonable means.
The updated Terms will identify their effective date. Where applicable law requires your affirmative consent to a change, we will request that consent. Otherwise, your continued use of Casa after the updated Terms become effective constitutes your acceptance of the revised Terms to the extent permitted by applicable law.
These Terms, together with the Privacy Policy and any other terms expressly incorporated by reference, constitute the agreement between you and EveryFit regarding your use of Casa and supersede any prior or contemporaneous agreements, communications or understandings regarding your use of Casa.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by applicable law.
EveryFit's failure to exercise or enforce any right or provision of these Terms does not waive its right to exercise or enforce that right or provision later.
You may not assign or transfer your rights or obligations under these Terms without EveryFit's prior written consent. EveryFit may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets or similar transaction, subject to applicable law.
